Renewal on Form TM-R is ₹9,000 per class by e-filing, paid at actuals. The fifty per cent concession available to individuals, startups and small enterprises applies when you FILE a mark — it does not apply when you renew one. Renewal is ₹9,000 per class for everybody. Renewing inside the six-month grace window adds a ₹4,500 per class surcharge, so a three-class mark renewed on time costs ₹27,000 in government fees and ₹40,500 if late.

यह बात किसी भी अन्य बात से ज़्यादा owners को उलझाती है। घड़ी आपके certificate पर लिखी आवेदन की तारीख से चलती है, जो अक्सर ख़ुद certificate से तीन साल पहले की होती है।

Expiry से छह महीने पहले तक समय पर, उसके छह महीने बाद तक surcharge के साथ grace, छह से बारह महीने के बीच restoration, और बारह महीने के बाद mark हमेशा के लिए हटा दिया जाता है।
Section 25(3) के तहत Registrar को रिकॉर्ड में दर्ज address of service पर आने वाली expiry का notice भेजना ज़रूरी है। अदालतों ने माना है कि उस notice के बिना हटाना कानूनन गलत है। हमें number भेजें और हम file निकालेंगे।
केवल registered proprietor ही renew कर सकता है। अगर mark assign किया गया था और assignment कभी दर्ज नहीं हुआ, तो नया owner तब तक renew नहीं कर सकता जब तक Form TM-P process न हो जाए।
Registration चला जाता है, और उसके साथ Section 29 के तहत infringement का मुकदमा करने का अधिकार भी। आपके पास common law अधिकार और Section 27(2) के तहत passing off रहता है, लेकिन इसका मतलब है reputation, misrepresentation और नुकसान को शुरू से साबित करना।
