Renewal on Form TM-R is ₹9,000 per class by e-filing, paid at actuals. The fifty per cent concession available to individuals, startups and small enterprises applies when you FILE a mark — it does not apply when you renew one. Renewal is ₹9,000 per class for everybody. Renewing inside the six-month grace window adds a ₹4,500 per class surcharge, so a three-class mark renewed on time costs ₹27,000 in government fees and ₹40,500 if late.

Validity runs ten years from the date of FILING the application, not from the date the certificate arrived. A mark filed in 2016 and registered in 2019 came up for renewal in 2026.

This trips up more owners than any other point. The clock runs from the application date on your certificate, which is often three years before the certificate itself.
The fifty per cent concession applies at filing only. Renewal is ₹9,000 per class for everybody, which surprises almost every startup that filed at ₹4,500.
On time up to six months before expiry, grace with surcharge for six months after, restoration between six and twelve months, and after twelve months the mark is permanently removed.
Section 25(3) requires the Registrar to send notice of approaching expiry to the address of service on record. Courts have held that removal without that notice is bad in law. Send us the number and we will pull the file.
Only the registered proprietor can renew. If a mark was assigned and the assignment was never recorded, the new owner is locked out until Form TM-P is processed.
The registration goes, and with it the right to sue for infringement under Section 29. You keep common law rights and passing off under Section 27(2), but that means proving reputation, misrepresentation and damage from scratch.
