CW · OVERVIEW

Kolkata's patent office is the head office

Many people assume patents are handled in Delhi. The Patent Office has four locations, and Kolkata is the one not described as a branch: IP India lists the New Delhi, Mumbai and Chennai offices as branches and gives Kolkata jurisdiction over the rest of India. For a West Bengal inventor, that means the Kolkata office in Salt Lake Sector V is the appropriate office for the application.

In practice the location matters less than it used to. Applications are e-filed, and your patent agent attends hearings and correspondence for you. But the appropriate office still has to be identified correctly in Form 1, and it decides where the application is examined and where any hearing is held.

Kolkata's jurisdiction is wider than the city. It also covers the other states not assigned to the Delhi, Mumbai or Chennai branches, so applicants from Bihar, Jharkhand, Odisha and the north-east file with the same office.

CW · WHO IT APPLIES TO

How the appropriate office is decided

Your situationAppropriate office
Individual inventor living in Kolkata or anywhere in West BengalPatent Office, Kolkata
Company or LLP with its place of business in West BengalPatent Office, Kolkata
Invention actually originated at a Kolkata facility, applicant elsewhere in IndiaKolkata can be the appropriate office on that basis
Joint applicants in different regionsThe office for the applicant first named, on any one of the grounds
Applicant with no residence or business in IndiaBased on the address for service in India or the patent agent's place of business

The tests are residence, domicile, place of business and the place where the invention originated. A Bengaluru-registered startup with an R&D unit in Salt Lake, for example, needs to choose its ground deliberately, because the appropriate office, once fixed, is not ordinarily changed in later proceedings on the application.

Startup recognition for fee concessionsDPIIT, onlineNeeded before claiming startup fees in Form 28

A product launch usually needs more than one of these. The invention is a patent question, the product name is a trademark question, and startup status is a DPIIT registration in Kolkata question that should be settled before the patent fee is paid.

CW · DOCUMENTS

Documents required

  • Invention disclosure: title, field, problem solved, how it works and what is new
  • Drawings, flow charts or circuit diagrams
  • Names, addresses and nationality of every inventor
  • Applicant details, with the company or LLP's registration if it is the applicant
  • Assignment from the inventors where the applicant is not the inventor
  • DPIIT recognition certificate or proof of small-entity status, for Form 28
  • Details of any corresponding foreign applications, for Form 3
  • Form 26 power of attorney in favour of our registered patent agent partner
CW · PROCESS

The process, step by step

Step 1. Invention review

We go through your disclosure and prototype, flag anything already made public, and decide whether a patentability search is worth running.

Step 2. Provisional or complete

A provisional fixes the priority date while development continues; a complete specification is filed when the invention is final.

Step 3. Drafting by the patent agent

Our registered patent agent partner drafts the specification and claims from the brief we prepare with you, and you approve the draft.

Step 4. E-filing with the Kolkata office

Form 1, Form 2, Form 3, Form 26 and, where eligible, Form 28 are filed online with Kolkata as the appropriate office. The application number and priority date are issued on filing.

Step 5. Complete specification and examination

Within 12 months of a provisional, the complete specification follows with Form 5. Form 18, or Form 18A for expedited examination, is filed within 31 months of priority.

Step 6. Objections and grant

After the first examination report the application must be put in order within six months, extendable by three. Any hearing is fixed by the Kolkata office and attended by the patent agent.

All plans exclude GST. Official Patent Office fees are paid at actuals and shown separately on your invoice.

All fees and charges listed are indicative only and do not constitute a binding offer. Final amounts may vary depending on the volume of work and the complexity involved.

CW · ONGOING COMPLIANCE

Fee concessions for Kolkata startups and MSMEs

ApplicantHow to claim the reduced feeForm 18A
Individual inventorApplicant details in Form 1Only on another Rule 24C ground, such as a female applicant
DPIIT-recognised startupForm 28 with the recognition certificateEligible
Small entity (MSME)Form 28 with proof of statusEligible
Educational institutionApplicant details and supporting proofOnly on another Rule 24C ground

The difference is large. A company outside these categories pays five times the reduced fee on filing and examination. If a Kolkata startup plans to file in a founder's name and move the application to the company later, the fee difference becomes payable on the transfer, so it is usually cleaner to recognise the startup first and file in the company's name with an assignment from the inventors.

CW · COMMON MISTAKES

Mistakes we see on Kolkata patent files

  • Presenting the invention at a college fest, trade fair or investor pitch before filing.
  • A provisional that describes the idea in two paragraphs and leaves the real invention for later.
  • Filing in a founder's personal name when the company will make and sell the product.
  • Claiming startup fees before DPIIT recognition is in place.
  • Choosing an appropriate office on a ground that does not apply to the applicant.
  • Forgetting Form 18 because no one is tracking the 31-month date.

CW · LOCAL SCENARIO

A Kolkata example

Two engineers in Salt Lake developed a sensor that warns of overheating in transformer panels and had a demonstration booked with a utility in six weeks. They had already registered a private limited company but had not applied for DPIIT recognition. We secured recognition first, took an assignment from both engineers to the company, and our patent agent partner filed a provisional specification with Kolkata as the appropriate office and Form 28 for startup fees. The demonstration went ahead after the priority date was fixed, and the complete specification was diarised for month ten.

CW · FAQ

Patent Registration in Kolkata - questions we get

Which patent office handles applications from Kolkata?

The Patent Office, Kolkata, at CP-2, Sector V, Salt Lake City, Kolkata 700091. Its jurisdiction covers the rest of India not assigned to the Delhi, Mumbai and Chennai branches, which includes West Bengal and the eastern and north-eastern states.

Do we need to visit the Salt Lake office to file a patent?

No. Applications are e-filed, and correspondence and hearings are handled by the registered patent agent. The Kolkata office still has to be named as the appropriate office where it applies.

Our company is registered outside West Bengal but the invention was developed in Kolkata. Which office applies?

The appropriate office can be fixed by the applicant's residence, domicile or place of business, or by the place where the invention actually originated. An invention developed at a Kolkata facility can make Kolkata the appropriate office, but the ground should be chosen with care.

What does patent filing in Kolkata cost?

Our professional fee starts at Rs 17,499 plus GST for a provisional filing. Official fees are Rs 1,600 for the application and Rs 4,000 for examination for individuals, startups and small entities, or Rs 8,000 and Rs 20,000 for others.

Is CorporateWalla a registered patent agent?

No. Drafting, filing and prosecution are handled by our registered patent agent partner, authorised through Form 26. CorporateWalla coordinates the invention review, brief, documents, fee category and deadlines.

How does a Kolkata startup get the reduced patent fee?

By holding DPIIT startup recognition and filing Form 28 with the certificate. A small entity under the MSME law claims the same way with proof of status. Form 28 has no fee, and both categories can also request expedited examination in Form 18A.

Can a student or professor in Kolkata file a patent personally?

Yes. An individual inventor pays the reduced fee. Where the invention was made using an institution's resources, its IP policy may require the institution to be the applicant, so check that before filing.

How fast can a Kolkata startup get a patent examined?

With expedited examination in Form 18A, available to startups and small entities at a fee of Rs 8,000, the examination report is ordinarily issued much sooner than in the normal queue. Grant still depends on the objections raised and your replies.

Where is the trademark office in Kolkata?

Trademarks are handled separately by the Trade Marks Registry at Nizam Palace, A.J.C. Bose Road, Kolkata 700020. A product usually needs both: a patent for the invention and a trademark for its name.

What happens if we miss the 31-month examination deadline?

The application is treated as withdrawn. That is why we usually file Form 18 together with the complete specification. See our patent registration page for the full deadline table.
