Ahmedabad employers with ten or more workers at a workplace must constitute an Internal Committee, adopt a POSH policy, conduct awareness programmes and prepare an annual report each calendar year. For the city's textile, chemical, pharma, engineering and trading MSMEs, the obligation is usually triggered by a headcount that includes contract and agency workers — not by the payroll figure the promoter has in mind.
Ahmedabad's employer base is heavily weighted towards owner-run businesses across the industrial estates and the corporate belt. The recurring pattern is a promoter who counts eight salaried employees and does not count the twelve contract workers, the two drivers and the housekeeping staff supplied by an agency.
The POSH Act counts them all. Regular, temporary, ad hoc, daily-wage, contractual, probationary, apprentice and intern engagements — paid or unpaid, and including workers engaged through a contractor — all count towards the ten-worker threshold at that workplace.
An Ahmedabad business address is not automatically Ahmedabad district. Facilities in the surrounding industrial belt, and offices in the GIFT City area, are administered by neighbouring district administrations.
Confirm the district for each Gujarat premises and the current District Officer, format and deadline before filing. The POSH Act prescribes no national deadline; district practice commonly follows 31 January for the preceding calendar year.
Two practical points decide whether an Ahmedabad committee works:
Yes, if the unit employs ten or more workers, counting contract and agency-supplied staff.
No. The external member must be independent and must meet the statutory description — from an NGO or association committed to the cause of women, or a person familiar with issues relating to sexual harassment.
Constitute a committee at each administrative unit and confirm the District Officer for each district before filing.
It is not separately mandated, but dissemination and display must be effective. For a Gujarati-speaking workforce, a bilingual policy and display is the practical standard.
Up to ₹50,000 under Section 26 for the first offence, with twice the punishment and possible cancellation of licence or registration on a repeat offence.
