Kolkata's business address is not always Kolkata district

Sector V, Salt Lake and the New Town–Rajarhat belt — where a large share of the city's IT and back-office employers sit — are administered outside Kolkata district. An organisation with a central Kolkata office and a Sector V development centre may therefore be reporting to two different District Officers.

Confirm which district each of your West Bengal premises falls in, and the current District Officer, submission route and deadline for each, before filing. The POSH Act prescribes no national deadline; district practice commonly follows 31 January for the preceding calendar year.

The SME and professional-practice gap

Kolkata's employer base is weighted towards trading houses, family businesses, professional practices, education and healthcare. In these organisations POSH compliance tends to fail in one of three ways:

  • "We are a family business." The Act does not care. Ten or more workers at a workplace triggers the committee obligation regardless of ownership structure.
  • "We are a partnership, not a company." The Act applies to the employer and the workplace. LLPs, partnership firms and proprietorships are covered. What does not apply to them is the Companies Act Board's Report disclosure.
  • "We only have six people on the payroll." Once interns, contract staff, drivers, housekeeping and agency-supplied workers are counted, many of these workplaces are above ten.

For employers genuinely below ten workers, there is still work to do: a policy, the display, and telling employees that complaints go to the Local Committee constituted by the District Officer.
