Delhi did not adopt its own societies statute the way Haryana, Karnataka or West Bengal did. It still applies the central Societies Registration Act, 1860, with Delhi-specific amendments. For years that left a gap the Delhi High Court noticed. In Indian Veterinary Association v. Govt of NCT of Delhi (December 2021) the Court held that the Delhi Registrar had no power to cancel a registration, because Delhi had not enacted the amendment other states had, and it asked the Registrar to run at least a basic check for identical or similar names before registering a new society.
The Societies Registration (Delhi Amendment) Act, 2026 closes that gap. It was passed by the Delhi Legislative Assembly on 27 March 2026 and received the Lieutenant Governor's assent on 23 April 2026. It inserts Section 12-D into the Act as applicable to Delhi, letting the Registrar cancel a society's registration where the registration or name violates the Act or another law, where its activities conflict with its stated objectives or public policy, or where the registration or renewal certificate was obtained by misrepresentation or fraud.
Before cancelling, the Registrar must give the society a reasonable opportunity to respond, including the chance to change its name or objectives. An appeal lies to the Divisional Commissioner within one month of the order, and the Divisional Commissioner's decision is final. In practice this means the objects clause and the name now carry real risk after registration, not only at the filing stage.
Section 20 of the Act lists the purposes a society may be formed for: charitable purposes, promotion of science, literature or the fine arts, instruction and diffusion of useful knowledge, political education, libraries and reading rooms, public museums and galleries, and similar objects. In Delhi the structure is common for:
A society suits a group of seven or more people who want a membership body that elects its governing body. Where control should stay with one settlor or family, a trust is simpler: see trust registration in Delhi. Where CSR funding and institutional donors are the priority, consider a Section 8 company in Delhi NCR.
Scope: this page covers societies with their registered office in the NCT of Delhi. A society in Gurugram or Faridabad is registered under the Haryana Registration and Regulation of Societies Act, 2012, and one in Noida, Greater Noida or Ghaziabad under the Act as amended by Uttar Pradesh. Neither is covered here.
| Function | Authority in Delhi |

| Application route | e-District Delhi portal, Department of Revenue |
| Certified copy of rules and governing body details | e-District service, prescribed timeline 60 days |
| Amendment of name, address, objects or rules | Registrar of Societies, on the documents the Registrar prescribes |

Note that a housing or thrift and credit society is a different creature. Those are cooperative societies registered with the Registrar of Cooperative Societies, Delhi, under cooperative law, and are not formed under the 1860 Act.
The Registrar's checklist is revised from time to time. We use the checklist current on e-District on the date of filing rather than a fixed list.
We confirm the seven or more founders, the governing body, and two or three name options. Because of the 2021 High Court direction and the new Section 12-D, a name that is identical or deceptively similar to an existing society is now a real risk, so we search before drafting.
Objects are written within Section 20 and to qualify as charitable for income-tax purposes. The rules cover membership, elections, meetings, quorum, accounts, amendment under Section 12 and dissolution under Sections 13 and 14, so that surplus assets cannot pass to members.
Each founder signs the memorandum and three governing body members certify the rules. Declarations are executed on e-stamp paper where the Registrar's checklist requires them.
We create or use the applicant login on the e-District portal, select the society registration service, upload the documents and pay the fee shown at filing.
The Registrar examines the objects, the name and the documents, and may raise objections or call for clarification. We respond to objections and, where asked, arrange for members to appear.
On approval the Registrar certifies that the society is registered under Section 3, and the certificate is issued through the portal.
We apply for the society's PAN, help open its bank account and file Form 104 with CIT (Exemptions), Delhi. See 12A and 80G registration. Our society registration guide explains the stages in more detail.
| Stage | Typical duration | Depends on |
|---|---|---|
| Name search, drafting and member sign-off | 5 - 10 working days | How quickly seven members sign |
| e-District filing | 1 - 2 working days | Document quality |
| Registrar scrutiny to certificate | Up to 60 days | The prescribed e-District timeline and any objections |
The 60-day figure is the timeline e-District Delhi lists for the service. Objections restart part of the clock, which is why the drafting stage matters.
| Head | Position in Delhi |
|---|---|
| Registration fee | Fixed by the Delhi government under Section 3 and shown on e-District at the time of filing |
| Stamp duty on declarations or affidavits | Under the Indian Stamp Act, 1899 as applicable to Delhi, through e-stamp |
| Certified copies | At the e-District prescribed charge |
| Annual list filing and amendments | At the Registrar's prescribed charge, where one applies |
| PAN for the society | Nominal fee to the PAN agency |
| Section 332 and 354 registration | No government fee |
We do not quote a fixed Registrar fee here because we could not confirm the current figure from an official Delhi source on the date of review. The fee shown on e-District when we file is what you pay, at actuals, and we confirm it at quote stage.
| Plan | Professional fee | Covers |
|---|---|---|
| Society registration | From Rs 5,999 | Name search, memorandum and rules, member documentation, e-District filing and replies to objections |
| Society plus tax registration | On quote | The above plus PAN and the Form 104 application |
| Annual compliance | On quote | Annual governing body list, minutes, amendments and income-tax return |
All plans exclude GST. Registrar fees, stamp duty and other government charges are paid at actuals and shown separately. Payment: 50% upfront, 50% on delivery.
All fees and charges listed are indicative only and do not constitute a binding offer. Final amounts may vary depending on the volume of work and the complexity involved.
Section 4 of the Act requires a society to file, once a year, a list of the names, addresses and occupations of its governing body. The list is due on or before the fourteenth day after the annual general meeting, or in January where the rules do not provide for an annual general meeting.
After Section 12-D, a society whose activities drift from its registered objects risks cancellation, not just a query. Keeping the objects current through a formal amendment is cheaper than defending a show-cause notice.

A group of nine retired teachers in Mayur Vihar wanted to run evening classes for school dropouts and planned to call the society by a name almost identical to a long-established Delhi education society. We flagged the name in the pre-filing search, and the founders chose a distinct one. Their draft objects also allowed members to be paid for teaching, which we limited to reasonable remuneration for services actually rendered by non-governing body staff. The application was filed on e-District, one objection on the premises NOC was answered, and the certificate was followed by a Form 104 filing with CIT (Exemptions), Delhi.

Section 4 requires a yearly list of the governing body's names, addresses and occupations, filed within fourteen days after the annual general meeting, or in January if the rules do not provide for one. The society also files its income-tax return.
