India has four patent offices: the head office at Kolkata and branches at Delhi, Mumbai and Chennai. Under Rule 4 of the Patents Rules, 2003, the appropriate office for an application is the one whose territory covers where the applicant, or the first-named applicant if there are several, normally resides, is domiciled or has a place of business, or where the invention actually originated. An applicant with no place of business or domicile in India uses its address for service in India instead.
| Office | Territory |
|---|---|
| Patent Office branch, New Delhi | Delhi, Haryana, Uttar Pradesh, Punjab, Rajasthan, Himachal Pradesh, Uttarakhand, and the UTs of Chandigarh, Jammu and Kashmir and Ladakh |
| Patent Office branch, Mumbai | Maharashtra, Gujarat, Madhya Pradesh, Goa, Chhattisgarh, and Daman and Diu and Dadra and Nagar Haveli |
| Patent Office branch, Chennai | Andhra Pradesh, Karnataka, Kerala, Tamil Nadu, Telangana, Puducherry and Lakshadweep |
| Patent Office, Kolkata (head office) | The rest of India |
All of NCR therefore sits with one office. A Gurugram startup, a Noida electronics maker and an inventor in Rohini all file with the Delhi branch. Once fixed, the appropriate office is not ordinarily changed, although the Controller can transfer an application, and a further application under Section 16 goes to the office of the first application.
Two cases need care. Where a Delhi company files jointly with a co-applicant elsewhere, the first-named applicant decides the office, so the order of names matters. And a foreign parent filing for an invention developed by its Gurugram or Noida engineering centre should look at where the invention originated, not only at the parent's address for service.

Patent filers in NCR range from DPIIT-recognised startups in Gurugram and Noida to engineering and pharmaceutical companies in Faridabad and the industrial belts of Haryana and western Uttar Pradesh, and individual inventors and academic researchers across Delhi. The first question for each is the applicant category, because the official fee schedule has two columns and the gap is roughly five times.
| Applicant | Fee column | How it is claimed |
|---|---|---|
| Individual inventor | Reduced | Applicant details in Form 1 |
| DPIIT-recognised startup | Reduced | Form 28 with recognition certificate |
| Small entity | Reduced | Form 28 with proof of status |
| Educational institution | Reduced | Applicant details and supporting proof |
| Other companies and LLPs | Standard | Not applicable |
A founder who files in a personal name to save fees and later assigns to the company pays the difference on transfer, so the cheaper route is usually to get the company its DPIIT recognition in Delhi NCR first and file in the company's name. The national rules are on our patent registration page and in the patent filing guide.
CorporateWalla is a CA and CS practice, not a patent agent. Patent specifications and claims are drafted, filed and prosecuted by our registered patent agent partner, who is authorised to act for you through Form 26. Our team runs everything around that work.
| Task | Who does it |
|---|---|
| Invention disclosure review and drafting brief | CorporateWalla with you, then the patent agent partner |
| Patentability search and opinion | Patent agent partner |

You share the invention under confidentiality. If ordered, a patentability search is run before drafting begins.
A provisional locks the priority date while the product is still changing. A complete specification is filed directly if the invention is final.
Our patent agent partner drafts from the brief. You approve the final text and drawings.
Form 1 with Form 2 and the supporting forms are filed online, and the application number and priority date are issued.
After a provisional, the complete specification follows within 12 months. Form 18, or Form 18A for eligible applicants, is filed within 31 months of priority.
After the examination report, the application must be put in order within six months, extendable by three. Replies and any hearing lead to grant or refusal.
| Stage | Indicative time | Depends on |
|---|---|---|
| Disclosure review and drafting brief | 3 - 5 working days | Clarity of the invention disclosure |
| Provisional drafting and filing | 10 - 15 working days | Complexity and your review |
| Complete specification | Within 12 months of the provisional | Statutory deadline |
| Publication | After 18 months, earlier on Form 9 | Statutory timeline |
| Examination request | Within 31 months of priority | Statutory deadline |
| Reply to objections | Within 6 months, extendable by 3 | Statutory deadline |
Indicative service timelines. Grant depends on the Patent Office's examination and is not guaranteed.

Rule 24C allows expedited examination for specified applicants, including startups, small entities, female applicants and certain government bodies. For an NCR startup the case is often commercial: a granted patent, or at least an examination report, before a funding round or a large customer contract.
The usual sequence for a Gurugram or Noida startup is DPIIT recognition, a provisional filing to lock priority before public demos, then the complete specification with Form 18A within the 12-month window.
| Deadline | Time limit | If missed |
|---|---|---|
| Complete specification after a provisional | 12 months | Application deemed abandoned |
| Form 3 statement on foreign filings | 6 months from filing | Ground for objection or revocation |
| Form 5 inventorship declaration | With the complete specification, or 1 month with permission | Objection |
| Form 18 request for examination | 31 months from priority or filing | Application treated as withdrawn |
| Putting the application in order | 6 months from the first examination report, extendable by 3 | Application deemed abandoned |
| Renewal fees | Annually from the 3rd year | Patent ceases to have effect |
| Patent | Trademark | Copyright | |
|---|---|---|---|
| Protects | A new, inventive, industrially applicable product or process | A brand name, logo or mark | Expression: code, content, designs as works |
| Office for NCR filers | Patent Office branch, Delhi | Trade Marks Registry | Copyright Office |
| Term | 20 years from filing | 10 years, renewable | Generally life of the author plus 60 years |
| Needs secrecy before filing | Yes | No | No |
Most NCR product companies need more than one. The invention goes into a patent, the brand into trademark registration, and software code and content into copyright registration.

A Noida hardware startup with DPIIT recognition had built a sensor module for cold-chain trucks and was due to show it to a logistics customer in Gurugram within a month. We checked its recognition and filed Form 28, and our patent agent partner prepared a provisional specification that went in through e-filing to the Delhi branch with an official fee of Rs 1,600. The demo went ahead after the priority date was secured. Ten months later the complete specification was filed with Form 18A at the startup rate of Rs 8,000.
Illustrative scenario based on typical file patterns. Not a named client engagement.
In Delhi NCR we also handle DPIIT registration and private limited company registration in Delhi. For the brand and the code, see trademark registration and copyright registration. For small-entity status, see MSME Udyam registration. Questions: contact us.

No. Applications are filed online through the Patent Office e-filing system, and e-filing carries the standard official fees. The Dwarka office is the appropriate office that processes your application, but filing, payment and most correspondence happen online through your patent agent.
Under Rule 4 the appropriate office follows the first-named applicant's residence, domicile or place of business in India, or where the invention actually originated. If the applicant has no place of business or domicile in India, its Indian address for service decides. Where the invention was developed in Gurugram, the Delhi branch is usually the right office.
No. CorporateWalla is a CA and CS practice. Patent specifications and claims are drafted, filed and prosecuted by our registered patent agent partner, authorised through Form 26. We handle the invention brief, applicant category, documents, fees and deadline tracking around that work.
A DPIIT-recognised startup pays the reduced e-filing fees: Rs 1,600 for the application, Rs 4,000 for the Form 18 examination request, or Rs 8,000 for Form 18A expedited examination. Extra sheets over 30 cost Rs 160 each and extra claims over 10 cost Rs 320 each. Form 28 with proof of recognition is filed to claim them.
Within 31 months from the priority date or the filing date, whichever is earlier, under Rule 24B as amended in 2024. If Form 18 is not filed in time, the application is treated as withdrawn. We usually file it together with the complete specification.
File provisional if the invention is still being refined or you need to show it soon, because it secures the priority date without claims. File complete if the invention is final. After a provisional, the complete specification must follow within 12 months or the application is deemed abandoned.
Yes. A natural person applicant pays the same reduced fees as startups and small entities. If the application is later transferred to a company outside those categories, the difference in fees is paid with the transfer request, so decide the applicant before filing.
For one invention: disclosure review, a provisional specification drafted by our registered patent agent partner, and Forms 1, 3, 26 and 28 where eligible, filed online to secure the priority date. Searches, complete specifications and objection replies are quoted separately. Fees exclude GST and official fees. Payment is 50% upfront and 50% on delivery.
